December Broker Report

2024 was, to put it lightly, a year of major change. The industry fundamentally shifted following the settlements of the commission lawsuits this past summer, affecting every part of real estate. However, instead of being stagnant or stubborn, CRMLS committed to adaptation, leading the way with settlement resources, new products, and partnerships.

The Big Rules & Policy Changes in August
After news of the settlements rippled throughout the industry, CRMLS created new rules and policies to ensure the highest level of transparency and accuracy in listing data.

  • All Buyer Agent Commission (BAC) fields on Active Listings were removed from CRMLS Matrix, Flexmls, and Paragon
  • New CRMLS Rules & Policies become effective (view a summary of the most significant changes)
  • Warning messages added to listing input to help users understand that offers of compensation is no longer permitted
  • Fines imposed on all listings that attempt to indicate forms of compensation

Concessions in Price and at Close
Concessions in Price (CiP) fields were introduced and quickly adopted by our user base. Concessions at Close are a new, mandatory set of fields to clarify how any concessions were used.

The frequently updated NAR Settlement Resource page led the standard on education and information about what was changing when during a tumultuous time.

CRMLS reached reciprocal access agreements between southern Florida’s BeachesMLS and the Mid-Atlantic’s Bright MLS, so CRMLS Matrix users can easily access listing data for any clients looking to move cross-country.

As part of the new policies resulting from the NAR commissions settlement, there can be no insinuation of compensation in listing fields such as Public Remarks. Read our list of the most common keywords that will prompt a system warning.

As we quickly approach 2025, please let this be a reminder that every January 1 the number of citations issued from the previous calendar year resets to zero.

As ever, to avoid receiving a citation, you must stay in compliance by adhering to the CRMLS Rules & Policies.

Keep in mind that, per CRMLS Rule 14.3.1, if any violations result in a fourth (or further) citation in any calendar year, both the violator and the violator’s Office Manager or Designated Broker, if applicable, shall appear before a Professional Standards hearing panel. Tuesday, January 21, 2025 @ 10:00 AM PT

“You have a scheduled showing but will be unable to attend due to a conflict. Which of the following is a permissible option in this situation?” 

a) Give your client your electronic key and tell them they can view the property on their own
b) Demand that the listing agent go to the property and conduct the showing
c) Go to the property and open the door for the client, tell them they can go in and look at the property, and then leave for your other appointment
d) None of the above

Answer: D

Rule 13.1 states that “Keys may not be used under any circumstances by anyone other than the key holder, including, but not limited to, lending, borrowing or sharing keys with others.” This means you cannot let your client use your key. Furthermore, Rule 9.9 states that a broker or agent “must be physically present on the property at all times when providing access to a listed property unless the Seller has consented otherwise”. Unless the seller gives you permission, you must be present with your client at the property to let them in and stay as long as they are there.
