CRMLS Seeks Judgment That Our Policies Are Fair and Sound
On October 5, 2026, CRMLS filed a complaint against Compass in the United States District Court for the Southern District of New York seeking a declaratory judgement proving our rules and policies are lawful.
This follows our refusal to give into Compass’s demands that would lead to a fractured and unequal marketplace. With this declaratory judgement, CRMLS is asking a judge to rule on the fairness of our policies prior to any suit Compass brings to change the rules in their favor.
The issue at hand is who can access listing data and whether everyone in an open cooperative has the same opportunity. We have accused Compass of “free riding,” which we define as getting the benefits of a cooperative marketplace (e.g., data, comparables, etc.) without participating or contributing back to that marketplace. This ruling would help us end this unfair strategy that disadvantages brokers, agents, and consumers alike.
Read our press release and the full complaint, both of which are hosted alongside more information and resources on our Protecting Cooperation Resource Page.
CRMLS is not the only entity targeted by Compass. They’re planning to sue any MLS that doesn’t give in to their demands. To combat any coercion that would make for an unequal or noncompetitive marketplace, we’re aiming to create the MLS Cooperation Legal Defense Fund. Organizations and leaders across our industry have already expressed interest in supporting its mission of openness and transparency.

Compass Files Its Own Suit Against CRMLS
On October 16, Compass filed an antitrust suit against us. In response, CEO Art Carter had this to say:
Compass’s decision to pursue litigation does not change our commitment to protecting a fair, transparent, and competitive real estate marketplace.
CRMLS stands firmly behind the principles of cooperation that have served brokers, agents, buyers, and sellers for decades. Our rules are designed to support fair competition, preserve seller choice, and ensure that no brokerage gains an unfair advantage by benefiting from the cooperative while withholding its own publicly marketed listings.
We believe cooperation is fundamental to a healthy real estate marketplace, and we will vigorously defend our rules and the interests of the real estate professionals and consumers who depend on them.
While we would have preferred to resolve these differences without litigation, CRMLS remains steadfast in its commitment to protecting the integrity of the cooperative marketplace.
