The Top Compliance Violation of 2022

With 2022 coming to a close, the Compliance Department has revealed the top violation encountered this year: “Failure to Correct a Violation”, an infringement of Rule 14.4.
The CRMLS Rule 14.4: Duty to Correct and Cooperate accounted for 16% of all citations issued. This number includes citations issued to both Participants and Subscribers, since maintaining accurate information and cooperating with CRMLS Compliance is the responsibility of both the Listing Agent and the Office Manager/Broker.
To avoid violating Rule 14.4, a Participant or Subscriber must correct any violation of the Rules and Regulations and bring the listing into compliance within 1 day of a Citation.
Furthermore, when a Listing Agent fails to correct a violation, the Office Manager or Broker of Record is subject to a citation and fine for failing to correct the subject violation. To avoid receiving a citation, an Office Manager or Broker of Record should follow up directly with Listing Agents regarding communications from CRMLS Compliance, including warnings or citations that the Listing Agent may have received as well as any violations that may remain uncorrected.
